Madoc 1170 Discussion Board Terms of Service
Madoc 1170 Limited (“Madoc 1170”) operates this discussion board (the “Discussion Board”). The following terms of service apply to all users of the Discussion Board. If you do not agree to these terms of service, you should exit the Discussion Board.
1. Conduct of Users of the Discussion Board
(a) All users of the Discussion Board are expected to show courtesy to others and demonstrate respect, good taste and decorum. Failure to do so may result in the immediate termination of a user's right to use the Discussion Board. Examples of unacceptable behaviour that are considered to violate these terms of service include:
(i) use of unlawful, harmful, threatening, vulgar, abusive or defamatory statements, language or images;
(ii) actions which intentionally cause distress, embarrassment, unwanted attention or other discomfort to another;
(iii) sending chain letters or other such junk mail; and
(iv) sending unsolicited advertising or promotional material to others.
(b) The above list is not exhaustive and Madoc 1170 reserves the right to prohibit conduct that it believes may be harmful to any person. Madoc 1170 reserves the right to monitor the Discussion Board to ensure that the requisite standards are being maintained. Madoc 1170 reserves the right to disclose any information to satisfy any legal, regulatory or other governmental requirements.
(c) Madoc 1170 also reserves the right to remove any information, messages or other material (the “Content”) that it deems in its sole discretion to be unacceptable, undesirable or in violation of these terms of service and to terminate the right of any user to use the Discussion Board who misuses or fails to abide by these terms of service.
2. Illegal or libellous statements
(a) A user of the Discussion Board must not make any libellous or illegal statements on the Discussion Board. A user of the Discussion Board must not otherwise expose Madoc 1170 or any of its respective directors, employees, affiliates or other representatives to liability for defamation or to any other civil or criminal liability by use of the Discussion Board.
(b) In using the Discussion Board, a user agrees to indemnify Madoc 1170 or any of its respective directors, employees, affiliates or other representatives against all costs and damages that Madoc 1170 or any of its respective directors, employees, affiliates or other representatives may suffer as a result of any breach by a user of these terms of service.
(c) Madoc 1170 reserves the right to remove in whole or part any posting that a user makes without liability to such a user for so doing.
(d) A user’s statements are personal and do not represent the views of Madoc 1170.
(e) Madoc 1170 does not in any way sanction illegal behaviour or defamatory publications.
3. Rules for Proprietary Material
(a) Users of the Discussion Board may not submit third party proprietary information to the Discussion Board without first obtaining permission from the owner. A user of the Discussion Board is solely responsible for any Content that is submitted, uploaded or posted on the Discussion Board by himself/herself and is liable for any damage resulting from any infringement of proprietary rights or any other harm. By submitting Content to the Discussion Board, a user grants Madoc 1170 an unrestricted, royalty-free, perpetual, worldwide right and licence to use, reproduce, modify, publish, translate and distribute the Content and/or to incorporate it in other works.
(b) Users may not in any way commercially exploit any Content obtained from the Discussion Board and must abide by the copyright and other proprietary restrictions and licences displayed in the particular Content. In the absence of any particular notices, a member may make copies of copyrighted, patented, trademarked or other proprietary materials displayed on the Discussion Board, provided that the materials are exclusively for personal use and that any notices contained in the material are maintained.
4. Information and Opinions Expressed on the Discussion Board
(a) Madoc 1170 makes no representation or warranties with respect to any information placed or opinions expressed on the Discussion Board by users. Users should exercise care in evaluating such information and opinions.
(b) Madoc 1170 does not guarantee the accuracy or completeness of any information or content, nor its satisfactory quality or fitness for any particular purpose. In many instances, the information provided may represent opinion and judgement and/or may have been supplied by a user not in any way under agreement with Madoc 1170. Under no circumstances will Madoc 1170 be liable for any loss or damage caused by a user’s reliance on information obtained on the Discussion Board.
5. General Disclaimer
(a) Madoc 1170 does not represent or make any warranty in respect of the accuracy, reliability or continuous supply of any of the Content contained on, distributed through, or linked, downloaded or accessed from the Discussion Board, or that the Discussion Board will be free of defects, including, but not limited to computer viruses or other harmful elements.
(b) Any reliance a user places upon any Content will be at such a user’s sole risk and it is solely a user’s responsibility to ensure that the Content meets his/her requirements. The user of the Discussion Board assumes all costs arising as a result of the use of the Discussion Board. Madoc 1170 reserves the right in its sole discretion, but without any obligation, to make amendments or improvements to, or withdraw or correct any error or omission in any portion of, the Discussion Board or any Content without notice.
(c) Madoc 1170 expressly disclaims any and all warranties, express or implied, to the extent permitted by applicable law, including without limitation warranties of fitness for a particular purpose, with respect to the Discussion Board or any Content.
(d) To the fullest extent permitted by applicable laws, and except in respect of death or personal injury arising from Madoc 1170's negligence, Madoc 1170 (including any of its respective directors, employees, affiliates or other representatives) hereby excludes liability for any claims, loss, demands or damages of any kind whatsoever with respect to the Discussion Board and the Content including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use, claims of third parties or otherwise and whether or not the possibility of such loss has been notified to Madoc 1170 or such loss was reasonably foreseeable. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise.
(e) Madoc 1170 makes no representations or warranties in respect of any endeavour by it to review the Content, and accordingly Madoc 1170 accepts no responsibility whatsoever for the accuracy, copyright compliance, legality or decency of any Content.
(f) While Madoc 1170 reserves its right to refuse to post or transmit or to remove any Content (in whole or in part) the posting or transmission of which would in Madoc 1170's sole discretion violate any right of any person or constitute an offence or a breach of any Madoc 1170 policy, notice or other requirement, subject to applicable law, Madoc 1170 has no obligation whatsoever to monitor any Content on the Discussion Board or to edit, delete or refuse to post or transmit any Content.

7. Governing Law
(a) The Discussion Board is operated by Madoc 1170 from the UK. Madoc 1170 does not make any representation that materials in and/or facilities or services offered through the Discussion Board are available for use in other locations or that they comply with any legal or regulatory requirements of such other locations. Users who use the Discussion Board do so at their own risk and on their own initiative and are responsible for compliance with local laws, to the extent that any local laws are applicable.
(b) These terms of service shall be governed by and construed in accordance with the laws of England and Wales. Any dispute under these terms of service shall be subject to the exclusive jurisdiction of the courts of England and Wales and, by using the Discussion Board, a user hereby submits to the jurisdiction of such courts for such purposes and waive any and all objections to jurisdiction or venue in such courts.
